1. Agreement to Terms

Welcome to Pump Logic! These Terms of Service (“Terms”) govern your access to and use of the Pump Logic mobile application (“App”), operated by Eduard Rusu (“we,” “our,” or “us”).

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that:

• You are at least 13 years old
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the App under applicable laws
• If you are under 18, you have obtained parental or guardian consent

3. Description of Service

Pump Logic is an AI-powered fitness tracking application that provides:

• Workout tracking - Log exercises, sets, repetitions, and weights
• AI Coach - Personalized fitness advice and workout generation
• Progress analytics - Track your fitness journey over time
• Leaderboards - Compare your progress with other users
• Achievements - Earn badges and milestones for your accomplishments
• Program management - Follow and customize workout programs

4. Account Registration

Creating an Account

To use most features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activities under your account

Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. We are not liable for any loss or damage arising from unauthorized access to your account.

5. Subscription and Payment

Billing

• Payments are processed through the Apple App Store or Google Play Store
• By subscribing, you authorize recurring charges to your payment method
• Subscription fees are billed in advance on a recurring basis

Cancellation

• You may cancel your subscription at any time through your device's app store settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods

Refunds

Refund requests are handled by the Apple App Store or Google Play Store according to their respective policies.

6. User Content

Your Content

You retain ownership of all content you create or upload to the App, including:

• Workout data and exercise logs
• Profile information and photos
• Chat messages with the AI Coach
• Feedback and comments

Prohibited Content

You agree not to upload, post, or transmit any content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Infringes on intellectual property rights of others
• Contains malware, viruses, or malicious code
• Violates the privacy or rights of others
• Is false, misleading, or fraudulent

7. Acceptable Use

You agree to use the App only for lawful purposes. You agree NOT to:

General Prohibitions

• Violate any applicable laws or regulations
• Impersonate any person or entity
• Interfere with or disrupt the App or its servers
• Attempt to gain unauthorized access to any part of the App
• Use the App for any commercial purpose without our consent
• Reverse engineer, decompile, or disassemble the App

AI Features

• Attempt to manipulate or “jailbreak” the AI Coach
• Use the AI for generating harmful, illegal, or inappropriate content
• Rely on AI advice as a substitute for professional medical guidance

8. AI Features Disclaimer

Exercise at Your Own Risk

• Always consult a physician before starting any exercise program
• Listen to your body and stop exercising if you experience pain or discomfort
• The AI cannot assess your physical condition or limitations
• You are solely responsible for your exercise decisions and safety

AI Limitations

• AI-generated content may not always be accurate or appropriate for your situation
• The AI does not have real-time awareness of your physical state
• Suggestions should be evaluated using your own judgment
• We are not liable for any injury or harm resulting from following AI advice

9. Intellectual Property

Our Property

The App, including its design, features, content, trademarks, and underlying technology, is owned by Eduard Rusu and protected by intellectual property laws. You may not:

• Copy, modify, or distribute any part of the App
• Use our trademarks without written permission
• Create derivative works based on the App

Your Data

You retain ownership of your personal data and workout information. See our Privacy Policy for details on how we handle your data.

10. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Termination

Termination by You

You may stop using the App and delete your account at any time through Settings > Account > Delete Account. Account deletion follows a 30-day grace period.

Termination by Us

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your use of the App poses a risk to other users or our systems
• We are required to do so by law

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOSS OF PROFITS, DATA, USE, OR GOODWILL, PERSONAL INJURY OR PROPERTY DAMAGE, OR ANY DAMAGES ARISING FROM YOUR USE OF THE APP.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Romania, unless you are a consumer in the European Union, in which case you may also bring proceedings in the courts of your country of residence.

15. Dispute Resolution

Informal Resolution

Before filing any formal legal claim, you agree to contact us at support@pump-logic.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

European Union Users

If you are a consumer in the European Union, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

16. General Provisions

• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Eduard Rusu regarding the App.
• Assignment: You may not assign or transfer these Terms without our prior written consent.
